These Terms of Use ("Terms") govern your use of frankdataconsultants.com, the interactive blueprint tool and any related pages (together, the "Site"), operated by Frank Data Technologies, LLC, doing business as Frank Data Consultants ("FDC," "we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
Who We Are
FDC is a data, automation and custom software consultancy based in Port Saint Lucie, Florida. The Site describes our services and lets businesses explore what a custom system could look like for them. The Site is intended for business use by people 18 or older.
The Blueprint Tool and AI-Generated Content
The blueprint tool uses artificial intelligence to turn your answers into a draft blueprint, including suggested builds, an example of a finished system, an example day and a time estimate. Please understand that:
- Blueprints are automated, AI-generated drafts. They may be incomplete or inaccurate, and the examples and estimates are illustrations based on your answers and simple assumptions.
- A blueprint is not a quote, proposal, guarantee, or legal, financial, tax, medical or other professional advice. Do not rely on it to make business decisions without independent review.
- Any figures, timelines or outcomes shown are not promises of results. Actual scope, pricing and results are set only in a written agreement signed by FDC.
- Using the Site, receiving a blueprint or booking a call does not create a client, consulting or confidential relationship. That relationship begins only when both parties sign a written agreement.
Your Submissions
You are responsible for the information you submit, including your answers, website address, name and email. You confirm that you have the right to share it. You grant FDC a non-exclusive, royalty-free license to use, store and process your submissions to generate your blueprint, contact you about it, operate and improve the Site, and as described in our Privacy Policy.
Please do not submit sensitive information. Do not enter patient or health information, your clients' confidential information, Social Security numbers, payment card or bank details, passwords, or any information you are not allowed to share. The blueprint tool is not designed to protect that kind of information.
Acceptable Use
You agree not to:
- Scrape, crawl or copy the Site or its outputs by automated means, or use them to build a competing product.
- Overload the Site, evade rate limits or usage controls, or submit requests in bulk or through bots.
- Attempt to manipulate the AI (for example through prompt injection), extract its instructions, or make it produce unlawful, harmful or misleading content.
- Probe, scan or test the Site's security, or reverse engineer, decompile or interfere with any part of it.
- Submit someone else's contact details without their permission, impersonate anyone, or use the Site for any unlawful purpose.
We may limit, suspend or block access to the Site at any time, for any reason, including to protect the Site or other users.
Intellectual Property
The Site, including its design, text, graphics, code, software and the format of the blueprints, is owned by FDC or its licensors and is protected by intellectual property laws. You may view the Site and use your own blueprint for your internal business evaluation. You may not otherwise copy, modify, distribute or create derivative works from the Site without our written permission. FDC's names and logos are our trademarks. Other names and logos shown on the Site belong to their respective owners, and their display does not imply endorsement.
Third-Party Services
The Site relies on third-party providers, including for AI processing, hosting, data storage, email, calendar scheduling and video meetings. Your use of features those providers power may also be subject to their terms. We are not responsible for third-party websites or services linked from the Site.
Privacy
Our Privacy Policy explains how we collect, use, keep and delete your information, including our automatic deletion schedule for blueprints. If you opt in to text messages, our SMS Terms also apply.
Disclaimers
THE SITE, THE BLUEPRINT TOOL AND ALL CONTENT AND OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ANY OUTPUT WILL BE ACCURATE OR COMPLETE.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FDC AND ITS MEMBERS, OFFICERS, EMPLOYEES AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR RELIANCE ON ANY OUTPUT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
Indemnification
You agree to defend, indemnify and hold harmless FDC and its members, officers, employees and contractors from any claims, losses and expenses (including reasonable attorneys' fees) arising from your submissions, your misuse of the Site or your violation of these Terms.
Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Site will be resolved by binding individual arbitration in St. Lucie County, Florida, except that either party may bring an individual claim in small claims court or seek injunctive relief to protect intellectual property. To the extent a dispute proceeds in court, the state and federal courts located in St. Lucie County, Florida, will have exclusive jurisdiction. You and FDC each waive the right to a jury trial and to participate in a class or representative action.
Copyright Concerns
If you believe content on the Site infringes your copyright, email greg@frankdataconsultants.com with a description of the work, where it appears on the Site and your contact details, and we will review and respond promptly.
Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted on this page, and we will update the "Last updated" date above. Your continued use of the Site after a change means you accept the updated Terms.
General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and FDC about the Site, and they do not replace any signed agreement for services.
